Unauthorised Seller Removal on Amazon UK

If third parties are selling your products on Amazon UK without your permission, you usually cannot remove them simply because you never authorised them. Once your stock has been sold into the UK or EEA market with your consent, your trade mark rights in those particular goods are generally exhausted. Removal works when there is a specific, defensible ground, not because a seller is unapproved. We find those grounds, act on them, and rebuild the listing so the Buy Box comes back to you.

Why being unauthorised is not enough

Most guidance on this subject is written for the United States, where the standard playbook runs on minimum advertised price and cutting off resellers who breach it. That approach does not transfer cleanly to the UK.

Two things get in the way. Under section 12(2) of the Trade Marks Act 1994, once goods are put on the market in the UK or EEA by you or with your consent, your rights in those goods are largely spent. Amazon applies the same logic: it treats consent from your supplier, or an upstream supplier, as enough. And dictating the price an independent reseller may advertise at risks falling foul of Chapter I of the Competition Act 1998.

So the question is never whether you approved a seller. It is whether there is a specific ground that stands up.

What does not work

  • Reporting a seller for being unauthorised. Amazon will close it.

  • Blanket intellectual property complaints with no substance behind them. Under the Intellectual Property (Unjustified Threats) Act 2017, a threat you cannot back can be actionable against you.

  • Enrolling in Brand Registry and expecting it to clear your listings. It is a toolkit, not an eviction notice.

  • Telling resellers what they must charge.

What does work

Removal succeeds where a seller is doing something independently wrong, or where the commercial route closes the door instead of the legal one. In practice that means identifying the specific defect in what a given seller is doing, evidencing it properly, and escalating it through the route Amazon actually responds to.

Some situations resolve through supply rather than enforcement. Where a brand controls who receives stock, the cleanest route is often to change the terms on which that stock moves, and to take the channel over directly.

Can you remove every unauthorised seller?

No, and anyone who says otherwise is selling you something. Some sellers hold stock you cannot touch. The appraisal tells you which ones are realistically removable before you commit to anything.
